Permission has been secured on appeal for the development of a former garage site in the countryside for two houses despite the Council arguing that it would be harmful to highway safety and the site not being in a highly sustainable location. Careful consideration of speed and accident data along the highway concluded that the proposed access was acceptable. The Inspector also accepted that whilst local services weren't located within 450 metres of the site they were within a ten minute walk, making the site accessible. He also noted the presence of bus stops in close proximity.
Planning Inspector Thomas Hatfield MRTPI also granted a partial award of costs against the Council stating:
"I find that unreasonable behaviour resulting in unnecessary or wasted expense has been demonstrated."
